We always learn a lot sitting through the cases ahead of ours. Usually “ex parte” (without a hearing) – domestic violence injunctions are extended at the hearing. Sometimes folks want to make a temporary injunction permanent. Very few permanent injunctions are granted. In many of these cases people think that this system is out there to deal with irritating people, scary people, or people that they no longer love or want to live with.
Domestic violence injunctions are supposed to be easy to obtain, and in many cases they are issued with no evidence at all, and in many cases they are extended with little of no evidence. Unfortunately,parenting or divorce issues are supposed to be taken care of in divorce and family courts, and not at a domestic violence injunction hearing. There will need to be either an act of violence, or an actual threat of violence. We have been involved in cases where we know that the allegations of domestic violence were not true nor supported, but an order was entered and extended. This allowed the person with the order to prevent the other from being in the home and having contact with the children. The domestic violence was argied at each step in the case and it had a very large impact on the final outcome.
If you are charged with domestic violence, do not cave in, agree to entry of an order for the sake of not having to hire an attorney or do anything but fight for what is true. If you are wrongfully accused of domestic violence it can follow you around for many years, and cost tens of thousands of dollars.
