In many cases you have substantial rights to protect yourself from being abused. But, unless you are willing to take action and see it through, then there is little hope. Florida law is simple to act on. If you are the victim of domestic violence that has just occurred, by all means first get to a safe place. DO NOT call a friend from your house in front of the abuser. That is likely to result in further injury. GET OUT – find a safe place. Call 911 and report the abuse. By all means, make the report and let the police help you. At a minimum the police are equipped to stop the abuse NOW. They have the resources to help you find safe shelter or put you back in your home.
The big problem is how to continue to live your life. First, visit your local Clerk of Court and see their Domestic Violence Clerk. Every county has one. They will explain what to do and help with the papers. If you do not have sufficient funds, they will waive the fees ans costs. Make sure you tell them everything, in detail. The things you leave out you may not be able to add later. In most cases the judge will sign an order protecting you almost immediately and just based on the paperwork.
In order to legally get a domestic violence injunction, it must be proven by that there is an immediate threat of harm or fear. If you do not state sufficient facts supporting this, then you may not get an order entered and will have to appear at a hearing within a few days to attempt to have the order entered. This hearing will be in open court and your abuser may likely be present, with a lawyer.
