Our prior PIP article addressed the effect of the new PIP law changes. Now it is clear how the public is getting RIPPED OFF!
Gov. Rick Scott signed the NEW PIP bill Friday (5-4-12), that he hailed as a victory for Florida drivers but critics slammed as a favor to generous friends in the insurance business!
Under the new PIP law a person injured in an auto accident will get NO PIP benefits unless:
1. They see a physician for the injury within 14 days post accident – then….
2. They are limited to $2,500 of the $10,000 they paid for unless a physician certifies that the injury requires further emergency treatment
3. Then and only then can the injured person receive their full $10,000 benefit.
In return for this “benefit” injured people give up their right to sue for causation of their injury unless they are “permanently injured” as defined in the Statute.
“In 1974, the Florida Supreme Court heard a constitutional challenge to the original 1972 PIP Statute, and found that the statute was constitutional because it offered a satisfactory quid pro quo – Floridians gave up their right to traditional tort remedies in exchange for swift payment of up to $10,000 in medical bills. That quid pro quo no longer exists.” (Marlene Reiss, Esq. – PIP Attorney).
This whole PIP issue is nothing but a favor to Governor Scott’s buddies in the insurance industry. And – we are all going to pay for it!
“It does nothing to fight fraud but merely pads the pockets of the insurance companies,” said Glenn Siegel, an attorney who handles PIP cases . “It often allows them to limit their payments to $2,500 but collect premiums paid for $10,000 worth of benefits. It’s not a coincidence the governor got a $100,000 check from United Automobile Insurance.” United Group Underwriters, an affiliate of United Automobile Insurance Co., gave $100,000 to Scott’s Let’s Get to Work political committee on March 7.
